Terms of Service

Your use of all services provided by Kentucky Academy constitutes your acknowledgement and agreement to these Terms of Service.

Account

In order to use our many services, you can create an account with us. You agree to always keep the information of your account and any applications accurate, current, and complete. You are responsible for your account's security and for all activities that occur on your account. You must notify Kentucky Academy immediately of any breach of security or unauthorized use of your account. You may be liable for any loss caused by your account that Kentucky Academy or others incur.

Violation of any of these Terms of Service may lead to suspension or termination of your account and services.

Rules of Use

You acknowledge and agree that:

1. You will comply with all applicable laws.
2. You will not use the services in a manner that interferes with the operations of Kentucky Academy's websites or networks or another entity's networks.
3. You will provide government-issued photo identification and debit/credit card scans as required for verification when requested.

Payment

You acknowledge and agree to supply appropriate advanced payment for the services received from Kentucky Academy.

Kentucky Academy reserves the right to change service prices and any other charges at any time, with or without notification.

Course Completion and Rush Service

If your license is with the Texas Department of Licensing and Regulations (TDLR), after you complete your course, Kentucky Academy will report your course completion within 7 days to the state according to TDLR's rules. But if you need us to do so sooner, you may order a Rush Service. The Rush Service will have us place your reporting at the top of our reporting queue before other students that we have. Although it typically results in our reporting within hours, we do not make any guarantee when it actually happens due to many unforeseen circumstances outside our control such as TDLR's system being down for maintenance. If we cannot process Rush Service for you, we may decide to issue you a refund at our discretion. To use our service, you knowledge that you understand the nature of this Rush Service and agree not to hold us responsible for not being able to report your course completion to TDLR on the same or next day, as long as we fulfill our legal duty to do so within 7 days according to the laws.

Reserved Rights

Kentucky Academy expressly reserves the right to deny, cancel, terminate, suspend, lock, or modify access to or control of any account or services for any reason as determined by Kentucky Academy in our sole discretion, including without limitation to the following: to comply with applicable law; to correct mistakes made by Kentucky Academy in offering services; to assist with our fraud and abuse detection and prevention efforts; to comply with requests of law enforcement; to comply with any dispute resolution process; to defend any legal action or threatened legal action without consideration for whether such legal action or threatened legal action is eventually determined to be with or without merit; or to avoid any civil or criminal liability on the part of Kentucky Academy, our officers, directors, employees and agents, users, as well as Kentucky Academy's affiliates.

Disclaimer

You specifically acknowledge and agree that your use of this website and the services found at this site shall be at your own risk and that this site and our services are provided “as is”, “as available”, and “with all faults.” Kentucky Academy, our officers, directors, employees, and agents disclaim all warranties, statutory, express or implied, including without limitation any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement. This includes wrong delivery, no delivery, and any and all service casualty caused by Kentucky Academy.

In addition, you specifically acknowledge and agree that no oral or written information or advice provided by Kentucky Academy, unless otherwise explicitly stated, will (i) constitute legal or financial advice or (ii) create a warranty of any kind with respect to our website or services, and users should not rely on such information or advice.

The foregoing disclaimer of representations and warranties shall apply to the fullest extent permitted by law, and shall survive any termination or expiration of these terms of use or your use of our website or services.

Indemnity

You agree to defend, indemnify, and hold harmless Kentucky Academy from any claims, demands, costs, expenses, liabilities, and damages of every kind and nature, including without limitation attorneys' fees, imposed upon or incurred by Kentucky Academy directly or indirectly arising from our services provided to you. The indemnification obligations under this section shall survive any termination or expiration of these terms or your use of our services.
